Personal vs Commercial Music Use: What's the Difference?

Here's the real difference between personal and commercial music use.

If your team has ever plugged a phone into the shop speakers and hit play on someone’s personal Spotify or Apple Music account, you’re in good company - a lot of retail and hospitality businesses have done it at some point. But that shortcut isn’t just against the streaming platform’s rules, it’s a breach of copyright law and the two are separate problems with consequences. 

The difference between personal and commercial music use isn’t about volume, genre, or how many people are listening. It comes down to one main thing - where the music is played.

Personal use - what it actually covers.

  • Listening at home, in the car, or through your own headphones for yourself
  • A personal Spotify, Apple Music, Amazon Music etc subscription, all licensed for private, non-commercial listening only
  • Buying or downloading a track, which gives you the right to listen to it - not to perform it in public 

Commercial use - what changes the moment you leave home.

  • Any premises outside a domestic setting: shops, cafes, gyms, salons, offices, waiting rooms, hotels, restaurants
  • Counts as a “public performance” - even if it’s only staff who can hear it, not customers 
  • Requires separate public performance licensing that no personal streaming subscription includes, at any tier

Why a personal account isn’t a workaround.

  • It breaches the platform’s own terms, and the law, separately. Spotify is explicit that its service is “only for personal, non-commercial use” - accounts used in a businesses can be suspended. That’s a different problem from copyright law, which requires its own public performance rights regardless of what any platform allows. 
  • Owning a track isn’t the same as being allowed to perform it. Buying, downloading or subscribing grants a personal listening right. Playing it publicly is a separate right entirely.

Frequently asked.

Does premium or an ad-fee plan count as commercial? No, removing ads doesn’t remove the personal-use restriction; it’s still a private-use subscription. 

Can I just upgrade my personal account instead? No, there’s no upgrade path from a personal plan to commercial rights. A personal subscription, at any tier, stays a personal subscription; a business needs its own public performance licence. 

What’s actually different day to day, beyond the legal side? A personal plan is built for one listener, with no control over content, no consistency across sites, and it stops the minute someone’s phone dies or they change the song. A business music service is built for the space - curated, brand-appropriate and runs reliably. 

Is there a size threshold? Does it apply to a small shop too? Yes. The requirement isn’t based on business size or number of premises; it’s based on whether music is played outside a domestic setting.
